Policies

AAFE tenants receive information regarding our housing policies when they lease an apartment, receive updates annually and as needed. They are encouraged to call the Property Management Office (Stanton Norfolk) with any questions or concerns. This page includes general information summarizing our policies on two common issues.

Transfer Policy
Current AAFE tenants may request a transfer to another unit in the same building or a different AAFE building so long as they have lived in their existing apartment continuously for at least 2 years (1 year for tenants 62+). Applicants will have an equal opportunity for a transfer and will be prioritized as follows: (1) transfers for emergencies and/or safety reasons; (2) transfers due to reasonable accommodation; (3) transfers due to a change in household composition. Transfer applications will be considered if/when there are availabilities. Tenants will be eligible for transfer if they are in good standing for the past 24 months, and they meet the applicable household size and income requirements outlined in the HPD regulatory agreement. Succession Rights Policy
AAFE models its policy regarding succession rights on guidelines from the New York State Division of Homes and Community Renewal (DHCR). A family member of a tenant in rent stabilized housing may have a right to a renewal lease when the tenant dies or permanently leaves the apartment. To be eligible, the family member must have been a primary resident in the apartment for the previous 2 yaers (1 year if the family member is 62+ or disabled). A family member is defined as either a spouse, son, daughter, stepson, stepdaughter, father, mother, stepfather, stepmother, brother, sister, grandfather, grandmother, grandson, granddaughter, father-in-law, mother-in-law, son-in- law or daughter-in-law of the tenant or permanent tenant. The definition also includes any other person living with the tenant as a primary resident who can prove emotional and financial commitment and interdependence. Tenants may provide notice (via DHCR Form RA-23.5) at any time to AAFE Property Management of the names of anyone (other than the tenant) residing in the apartment. Or, AAFE may at any time, but no more than once in any twelve months, request from the tenant the names of all such persons. The full DHCR policy is available here.
